Monsieur le ministre, en réponse au journal l’observateur, vous avez parlé d’amendement de l’article 63 de la constitution. Je vous précise qu’il ne peut y avoir d’amendement de l’article 63 de la constitution puisque cet article ne figure pas dans le projet de loi constitutionnelle N*07/2019 portant révision de la constitution, objet de la séance en commission du mardi 30 Avril 2019.
Cet article a été omis des articles à abroger et à remplacer comme je l’ai fait remarquer dans mes précédentes contributions.
Même si c’est heureux de voir que vous avez décidé de rectifier l’erreur, la procédure n’est pas la bonne.
La procédure devait consister à l’insertion de l’article 63 et sa modification dans le projet de loi 07/2019. Cela qui devait d’abord passer par l’amendement de l’article unique du projet de révision en son alinéa 1 qui liste les articles à abroger et à remplacer. Il fallait y insérer l’article 63 et ensuite mettre la nouvelle version de cet article dans les dispositions proposées.
Votre amendement est alors irrecevable puisqu’il ne concerne pas le projet de modification soumis à l’Assemblée nationale.
L’article 79 du règlement intérieur de l’Assemblée nationale est très clair: « les amendements ne sont recevables que s’ils s’appliquent effectivement aux textes en discussion ».
En amendant donc l’article 63, vous avez illégalement et inélégamment amendé une disposition de la constitution sénégalaise et non un article du texte en discussion soumis à l’Assemblée nationale.
