La proposition de loi N12/2019 modifiant et complétant la loi organique 2002-20 du 15 mai 2002, modifiée, portant règlement intérieur de l’assemblée nationale a encore déçu tous ceux qui s’attendent à des réformes substantielles pour une meilleure prise en charge des préoccupations des populations.
Les termes de l’article 80 Bis sont révélateurs de la plume qui se cacherait derrière cette retouche mineure. Cet article corse les dispositions déjà existantes pour réduire à néant les marges d’intervention du député dans le cadre d’un projet de loi de finance accroché aux exigences de l’entrée en vigueur du budget-programme en 2020.
Tout laisse croire que les députés de la majorité se sont encore conformés à un texte de l’exécutif pour en faire une proposition de loi.
La majorité avait l’occasion de se doter les moyens de se pencher sur le contrôle effectif du budget-programme prévu par les directives de l’Uemoa de 2009 et que le Sénégal va finalement intégrer en 2020.
Ce budget-programme va obliger l’Etat sénégalais à ne pas s’en tenir à des principes de politique générale, mais à se doter d’objectifs précis, arrêtés en fonction des finalités d’intérêt général et des résultats attendus mesurés par des indicateurs de performance.
Le budget-programme devrait alors permettre de renforcer l’information de l’assemblée et de son contrôle de l’exécution des lois de finance. Il faudra alors mieux se préparer au débat d’orientation budgétaire, organisé au plus tard le 30 juin de chaque année avec la présentation du DPBEP (Document de Programmation budgétaire et économique pluriannuelle) et des DPPD (Document de Programmation Pluriannuelle des Dépenses)…
Avec la toute prochaine application du budget-programme, la dite proposition de loi aurait pu, au moins, s’inspirer de l’évolution dans l’encadrement de l’initiative parlementaire avec notamment, par exemple, en France, le fait d’autoriser les parlementaires à opérer des mouvements entre les programmes d’une même mission sans augmenter le montant total des crédits de celle-ci. (La loi organique du 1er août 2001 relative aux lois de finances (LOLF)).
A la place d’une extension des prérogatives des députés compte tenu des nouvelles opportunités de contrôle, l’article 80 bis de la dite proposition se limite à restreindre l’initiative parlementaire.
La majorité a encore une fois raté l’occasion de rendre à l’assemblée nationale sa dignité de siège de représentation du peuple sénégalais après les coups de boutoirs successifs de l’exécutif qui ont fini par en faire une chambre d’enregistrement.
Il est vraiment regrettable que la majorité n’ait pensé qu’à augmenter ses privilèges à la place de ses responsabilités et de ses prérogatives. En augmentant le nombre de commissions de 11 à 14, la majorité ne fait qu’augmenter les postes de dépenses à la charge du contribuable sénégalais tout en ignorant ses attentes, notamment en terme de prise en charge des mécanismes de transparence et de suivi de l’exécution des lois votées. La commission comptabilité et contrôle qui est chargée de la transparence des ressources allouées à l’assemblée nationale n’a jamais produit de rapports destinés à l’assemblée, portant sur l’exécution du mandat de contrôle qui lui est confié conformément à la loi. Idem pour la commission de délégation dont la mission est de faire l’évaluation et le suivi de l’exécution des lois votées qui ne fonctionne pas, et ne fait que consommer des crédits gracieusement alloués.
En dehors d’un toilettage des articles du règlement intérieur de l’assemblée nationale exigé par l’obligation de se conformer aux nouvelles dispositions de la constitution qui supprime le poste de premier ministre et touche aux jeux des pouvoirs, la proposition de modification du règlement intérieur n’a été finalement qu’un prétexte pour annihiler les prérogatives de contrôle des députés, et octroyer des privilèges à une clientèle politique.
