Le parquet a choisi de faire appel pour s’opposer à la décision du juge d’instruction ordonnant la libération de Badara Gadiaga sous surveillance électronique.
Autrement dit, il refuse l’application d’une loi d’aménagement des peines votée par la représentation nationale pour rendre la justice plus humaine et limiter les abus de détention préventive.
Ce refus traduit une volonté manifeste de durcissement contre un citoyen dont le seul tort est d’avoir exprimé une opinion, dans le cadre d’un débat public.
Son contradicteur avait franchi toutes les limites de la décence en évoquant une histoire de « client et de prostituée ».
Lui, au lieu d’être sanctionné, a été récompensé par une nomination.
Et Badara a retrouvé la prison.

Il parle de justice mais pratique la revanche. Il parle de transparence mais blanchit les siens depuis un stade, sans attendre le moindre verdict.

Une justice prompte à instruire à charge dès qu’il s’agit d’un opposant ou d’un chroniqueur trop libre mais soudain lente, hésitante, lorsqu’il est question de présumés scandales d’État.
Une justice qui, au lieu d’incarner l’équilibre des pouvoirs, se transforme peu à peu en un instrument de contrôle politique, au service de la peur plutôt que du droit.
Badara Gadiaga est aujourd’hui le symbole d’un pays où parler devient un crime et se taire une complicité.
Le Président de la République, garant du bon fonctionnement des institutions, ne peut plus détourner le regard.
Laisser prospérer cette dérive, c’est fragiliser la République, c’est trahir l’État de droit.
Il est temps de mettre fin à cette mascarade, de rappeler que la justice n’appartient ni aux vainqueurs ni aux vaincus mais à la nation tout entière.
Le Sénégal ne peut pas continuer à jouer sa démocratie sur le dos de ses citoyens.
La justice n’est pas un champ de bataille. C’est le dernier refuge de la République.
Lorsqu’elle devient une arme, c’est la liberté elle-même qui saigne.
