Après la décision du Conseil constitutionnel qui a constaté l’impossibilité de tenir l’élection le 25 février à cause de l’immixtion intempestive sans base légale du Président de la République dans le processus électoral, l’unique date qui doit respecter les dispositions de l’article 31 couvertes du drap de l’intangibilité est le 3 mars prochain.
Le Président Macky Sall qui devait faire preuve de diligence pour respecter cette fourchette légale et intangible a préféré prendre tout son temps et espérer adouber l’argument de l’impossibilité faute de marge temporelle.
Dialoguer n’est jamais une mauvaise chose. Discuter, se concerter, mener des consultations… procèdent d’excellentes démarches dans une démocratie. Cependant, dura lex, sed lex (La loi est dure, mais c’est la loi).
Il est difficile pour un Président de la République qui avait l’habitude de fixer les règles du jeu, de ne plus avoir les cartes en main. C’est dur de voir ses réglages politiques de fin de mandat aller à vau-l’eau mais c’est ainsi. La loi doit prendre le dessus sur toute autre considération personnelle ou partisane.
La charte fondamentale de notre pays est extrêmement claire sur la question de la décision du Conseil constitutionnel : Elle n’est susceptible d’aucune voie de recours. Elle doit s’appliquer aux pouvoirs publics et aux autorités administratives et judiciaires.
C’est donc cette décision qui exclut toute forme d’allongement du mandat du Président de la République qui doit s’appliquer et non celle d’un Président de la République sortant qui cherche malencontreusement à s’immiscer sur le destin présidentiel des candidats.
Que le Président Macky Sall respecte nos institutions. Qu’il respecte nos lois. Qu’il respecte le peuple sénégalais.
Qu’il demeure le gardien attitré de la constitution en évitant de violer ses dispositions pertinentes surtout celles couvertes du drap de l’intangibilité.
