L’article 127 ter du code de procédure pénale largement évoqué dans ledit communiqué, ne fait aucune allusion à la prérogative du procureur de demander que la révocation du contrôle judiciaire soit effectuée, encore moins celle de justifier à travers un communiqué une telle mesure qui est du domaine exclusif du juge d’instruction.
Aujourd’hui, rien n’explique que l’option du procureur de revenir sur sa décision emporte, de jure, celle du juge qui devrait pouvoir intervenir directement sans y être aidé, au sens de la lettre des dispositions de l’article 127 ter du code de procédure pénale.
Si le procureur doit poursuivre ensuite demander et obtenir la révocation d’un contrôle judiciaire puis justifier à travers une communication cette révocation, il prend en définitive sa place et celle des juges d’instruction et se présente finalement comme ayant tous les droits sur des personnes qu’il décide de poursuivre sur la base du délit visé et selon des critères qui lui sont propres. Un précédent dangereux pour l’indépendance de la justice.
Pape Alé Niang a le droit de décrier cette injustice même si chacun peut avoir une opinion sur ses options.
En réalité, le mandat de dépôt doit être oublié
dans le cadre des délits d’opinion quand la liberté est quasiment la règle dans le cadre des détournements de deniers publics.
Humainement Pape Alé ne mérite pas un tel traitement au moment où des incriminés de faits graves vaquent tranquillement à leurs occupations. Il n’a ni volé ni tué ni violé. Il s’est juste exprimé.
Comme toute personne il peut commettre des erreurs et même des fautes professionnelles. Cependant l’emprisonner et le laisser souffrir au fond de sa cellule n’est pas humainement acceptable pour quelqu’un qui s’est toujours battu pour son pays.
