Le débat sur le statut du chef de l’opposition est moins important que beaucoup d’autres priorités de l’heure. Et surtout dans un contexte d’inondations où plusieurs familles sont plutôt préoccupées par la recherche de moyens de faire face aux difficultés quotidiennes. Cependant, traiter la question du statut du chef de l’opposition n’est pas moins important que chercher à reporter le débat avec autant d’énergie, pour n’importe quel prétexte et sur la base d’arguments parfois fallacieux. C’est une question qui doit être abordée et traitée comme toutes les autres questions inscrites dans l’ordonnancement juridique de notre pays.
Qui s’intéresse à ce débat ?
Qu’on se le tienne pour dit, ce débat a malheureusement pris une tournure hautement politique et les prises de positions des uns et des autres ne relèvent que de la pure stratégie. Certains cherchent à reléguer le débat au second plan, faute de pouvoir faire partie des leaders éligibles. D’autres veulent réfréner sa mise en œuvre de peur que ce soit une corde de plus à l’arc d’un opposant politique autre qu’eux-mêmes.
En réalité, si le Président Macky Sall voulait diviser l’opposition avec ce sujet, il a presque réussi. Ceux qui donnent leur point de vue sur les critères de choix, s’arrimant logiquement à une discussion dans le cadre d’un dialogue politique, sont apparemment moins à l’offensive que certains de ceux qui veulent noyer un tel débat. Ceux qui disent ne pas en faire une priorité, en font la priorité de leurs prises de parole et de leurs argumentaires, laissant en rade plusieurs autres questions brûlantes de l’heure.
Comme quoi, vouloir ranger dans les tiroirs la question du chef de l’opposition c’est aussi une manière de s’intéresser à cette question.
Sur l’opportunité de la désignation du chef de l’opposition
Les positionnements et la bataille politique au sein de l’opposition évoqués ci-dessus ne devraient pas nous détourner du principe selon lequel : les lois votées dans notre pays et a fortiori celles découlant d’un référendum ont pour vocation à être mises en œuvre, peu importe notre positionnement au moment de ce referendum ou notre position au moment de son application. Les lois transcendent les individus.
L’opportunité ne peut donc plus se discuter dès l’instant que le peuple s’est déjà prononcé sur la question. Même si le référendum de 2016 a été un fourre-tout et une démarche vicieuse de la part du gouvernement, il a permis aux Sénégalais de recevoir dans leurs terroirs les partisans du « non » et ceux du « oui ».
Le verdict a été favorable au « oui ». Le choix d’appliquer une série de mesures a été ainsi fait par le peuple sénégalais. Le dialogue politique n’est en réalité qu’une voie majeure devant permettre d’engager des discussions sur des questions essentielles, mais le choix de mettre en place un statut de l’opposition et son chef est déjà acté par le peuple souverain.
Sur les critères de choix du chef de l’opposition
Le statut de chef de l’opposition n’avait jusque-là été consacré que dans le cadre des pays utilisant le système de Westminster qui est un système parlementaire basé sur celui existant au Royaume-Uni. Cependant, la voie parlementaire ne peut être un critère pour notre pays.
En effet, au Sénégal, la dernière trace qui pouvait laisser penser au caractère parlementaire de notre régime démocratique a été effacée à travers le vote de la loi constitutionnelle n° 07/2019 visant la suppression du poste de Premier ministre. Avec cette loi, une majorité parlementaire découlant de l’opposition au pouvoir ne pourra plus occuper le poste de premier ministre et imposer une cohabitation. Il s’y ajoute que cette loi ne permet plus ni motion de censure ni refus de confiance au bénéfice des députés. Elle consacre, en définitive, le cloisonnement d’une Assemblée nationale qui subit le dictat d’un président de la République jouissant de pouvoirs exorbitants.
Notre régime politique est donc évidemment présidentiel. Dans un tel contexte, le critère de choix qui doit s’arrimer à la forme d’un tel régime ne peut vaciller ni être sujet à interprétation s’il se conforme à l’exigence de la légitimité démocratique.
« Le chef », désignation individuelle, ne peut qu’être une personne. Le poste de chef de l’Etat est obtenu à travers le suffrage universel direct. Ce vote qui est le rendez-vous d’un homme avec son peuple ouvre la voie présidentielle à celui qui aura été choisi par la majorité des Sénégalais. Le chef de l’opposition dans le cadre d’un régime présidentiel ne peut évidemment être que le candidat venu après celui qui a été désigné chef de l’Etat.
Aucun autre critère ne peut être conforme à l’esprit de notre régime politique et à l’exigence d’une légitimité populaire.
Sur le principe de la non-rétroactivité de la loi
Le principe de la non-rétroactivité a été évoqué sur cette question pour dénier au second de la présidentielle de 2019, la possibilité d’occuper ce poste. Sur cette question de choix du chef de l’opposition, il ne s’agit pas de faire rétroagir une loi mais bien de l’appliquer immédiatement. C’est le principe de l’application immédiate de la loi. Le chef de l’opposition sera, par conséquent, le candidat sorti deuxième de la dernière élection présidentielle.
D’ailleurs en ce qui concerne le HCCT, les 80 membres ont été élus sur la base de critères afférents aux élections locales de 2014, pour des lois votées deux années après ces élections, en 2016 (Loi organique n° 2016-24 du 14 juillet 2016 relative à l’organisation et au fonctionnement du Haut conseil des collectivités territoriales, Loi organique n° 2016-25 du 14 juillet 2016 modifiant le Code électoral et relative à l’élection des Hauts conseillers)
Et même, soit dit en passant, sans une application immédiate, la non rétroactivité a bel et bien des exceptions afin que nul n’en ignore. Dans la légistique, la formulation de la loi peut la rendre expressément rétroactive, ce qui est une exception au principe de la non-rétroactivité de la loi.
Le fait de parler de non-rétroactivité pour essayer de reporter le traitement de la question est donc un argument inopérant.
Ce principe ne s’oppose donc pas à la désignation d’un chef de l’opposition. Celui qui l’incarnera fera le choix de ses armes d’opposant et s’opposera à son rythme tout en sachant que ce poste pourra bel et bien migrer lors de la prochaine élection par le truchement du suffrage universel.
