Le 15 janvier 2014, dans une tribune intitulée « Baisse des loyers au Sénégal: Eclairage sur le projet de loi de l’Etat », nous avions attiré l’attention de l’Etat sénégalais sur les risques qu’encouraient les sénégalais avec cette loi « populiste ». Nous avions été vertement attaqué y compris par des organisations consuméristes qui pensaient (à leur décharge) être en face d’une loi qui réglaient un problème crucial pour les ménages.
Six année après, c’est Macky Sall lui-même dans le communiqué du conseil des ministres de ce 30 octobre qui fait le même constat. Il demande par conséquent « au Ministre du Commerce, en rapport avec les ministres chargés des finances et de l’Habitat, d’intensifier les actions de régulation des loyers par la mise en place d’un dispositif consensuel et opérationnel réglementant les activités immobilières sur l’ensemble du territoire national. Aujourd’hui, à travers une mesure populiste et démagogique, l’Etat sénégalais a finalement porté un préjudice énorme aux ménages les plus pauvres. Nous avons perdu six années à résorber une question essentielle pour les ménages tout en encourageant une spéculation monstrueuse.
Ci-dessous, ma tribune sur la question.
La volonté affichée par le gouvernement de réduire le prix du loyer jusqu’à atteindre des proportions raisonnables a été saluée par les sénégalais dans leur majorité. La mise en place d’une commission composée des acteurs du secteur et des spécialistes du domaine a fondé beaucoup d’espoirs sur la possibilité d’aller vers une baisse rapide et juste du coût du loyer. Cependant, tous ces espoirs risquent d’être déçus au regard du projet de loi soumis aux députés par le gouvernement sénégalais.

Cette décision régalienne de l’Etat va créer une instabilité regrettable dans les relations entre bailleurs et locataires qui avaient réussi à établir un accord privé et ne permettra pas, pour autant, de baisser le coût des loyers et de freiner la spéculation. Bien au contraire. En effet la mesure ne se prononce pas sur la fixation des prix des loyers mais seulement sur leur baisse s’ils ont été déjà fixés. Cela veut dire en terme pratique que le bailleur qui fixe son prix après le vote de cette loi ne sera pas concerné par la baisse imposée par l’Etat. Par conséquent, ce bailleur à qui on impose la baisse d’une location en cours peut se rattraper sur la fixation des prix dans le prochain contrat en majorant selon sa convenance. La loi se limite à exposer des fourchettes de prix sans aucune distinction liée au standing, à la zone d’habitation ou encore à la position d’habitation. Le bailleur est donc libre de choisir sa fourchette de prix et de la calquer sur ses intérêts économiques.

Le plus invraisemblable dans cette affaire est que l’Etat a décidé d’imposer une réforme sociale à incidence financière, sans aucune contre-partie financière de sa part. L’Etat va imposer aux bailleurs de réduire le loyer sans réduire lui-même les taxes qu’il leurs impose. C’est ainsi que l’impôt sur les revenus fonciers, la TOM, l’impôt sur le foncier bâti, la TVA sur les loyers mensuels… sont maintenus intacts. Ce qui constitue un abus de pouvoir manifeste.
L’argument soutenu par le gouvernement et selon lequel une étude a révélé que le coût de la construction n’a augmenté que de 44% alors que le coût du loyer est monté jusqu’à 256 % n’est pas un argument pertinent. Les faits révèlent que les coûts de matériaux de construction ont doublé. Il en est de même des taux d’emprunts bancaires qui sont parfois insupportables et peuvent évoluer de 7% à 10%. Quant au foncier, il fait l’objet d’une spéculation galopante. Le prix du m² a atteint des proportions inquiétantes dans certaines localités et l’Etat participe à cette spéculation à travers ses services. En effet les services fiscaux de l’Etat évaluent le foncier non pas sur la base de la loi mais sur la base du prix du marché, fruit de la spéculation. Par exemple le décret 2010-399 du 23 Mars 2010 portant fixation du barème des redevances pour occupation temporelle du domaine public de l’Etat fixe le barème le plus cher à Dakar à 300 000 f CFA le m² alors que l’évaluation des experts et des services fiscaux peuvent aboutir à des barèmes allant jusqu’à 1 000 000 f CFA le m². Une situation qui ne peut être sans conséquence sur le coût de la construction. L’argument de la régulation est donc une absurdité quand cette régulation se limite à la phase d’exploitation d’un investissement tout en ignorant le coût de l’investissement.
C’est également une absurdité que de comparer les prix des loyers avec les prix des denrées de premières nécessités. La détermination du prix des loyers par les bailleurs obéit à des spécificités qui ne peuvent s’accommoder à une application généraliste de la loi. Les bailleurs ne peuvent et ne doivent pas être vus du même œil. Certes, les bailleurs spéculateurs existent bel et bien mais l’Etat doit faire l’effort de les identifier et de les sanctionner en application des lois existantes. A côté du bailleur spéculateur, il y’a le bailleur qui fixe un prix raisonnable et qui ne fait pas recours à la surface corrigée. De même ils sont nombreux ces bailleurs qui tirent leurs revenus exclusivement de la location et dont le loyer est parfois adossé à un prêt bancaire. Ils ont le plus souvent une fourchette de location de moins de 150 000 f CFA et vont donc subir une baisse de 29% sur leurs revenus mensuels de survie en plus des charges d’emprunts bancaires.
D’un autre point de vue, la loi étant d’ordre général et impersonnel les taux fixés par l’Etat sont appliqués jusque dans les localités où aucune spéculation n’est notée. Or, il se trouve que dans certaines villes de l’intérieur du pays des bailleurs sont parfois obligés de réduire considérablement leurs prix de location compte tenu de la rareté de la demande. Les bailleurs qui vivent des situations différentes vont subir les taux imposés par l’état sans distinction aucune.
Le Gouvernement sénégalais a finalement décidé de gérer une question plus que sérieuse sous le prisme du populisme. Son empressement à récolter des dividendes nous expose à une situation insolite qui ne réglera pas pour autant le problème crucial du loyer.La responsabilité d’un Etat qui veut assister ses administrés qui vivent dans la situation décrite est d’agir sur le marché en diminuant la pression de la demande et en augmentant l’offre. Dakar représente 0,28 % du territoire national, concentre 25% de la population et 80% de l’activité économique. La situation de la capitale ne peut être sans conséquence sur le marché de l’offre et de la demande dans le secteur du loyer. L’Etat a la responsabilité de désengorger la capitale sénégalaise qui étouffe du fait de la concentration des activités économiques et administratives. Il doit favoriser la création de pôles de développement économique à travers le pays qui puissent permettre de fixer les populations et de freiner l’exode rural. L’Etat a la responsabilité de faire l’audit du foncier, de confier à ses structures comme la SN HLM et la SICAP la mission d’engager un vaste programme de construction de vrais logements sociaux et de veiller à ce que ces structures n’arriment pas leurs prix de vente sur les prix du marché, fruits de la spéculation. L’Etat ne peut, non plus, se soustraire de sa responsabilité de multiplier les sources de revenus dans les familles en créant des emplois et ainsi permettre à ces familles de supporter le coût de la vie qui ne se résume pas à la cherté du loyer.
NB: Le projet de loi n° 04/2014 portant baisse des loyers n’ayant pas été calculés suivant la surface corrigée consacre à son article premier une diminution de 29% pour les loyers inférieur à 150 000 f, 14% pour ceux compris entre 150 000 f à 500 000 f, 4% pour les loyers supérieurs à 500 000 f. L’article 2 dispose que cette loi ” s’applique à tous les baux à usage d’habitation en cours”. Et enfin le troisième et dernier article dispose que “toute violation de la présente loi expose son auteur aux sanctions prévues par la loi n° 81-21 du 25 juin 1981 réprimant la hausse illicite du loyer des locaux à usage d’habitation”.
