En 2012, en notre qualité de député de la 12ème législature nous avions énormément marqué notre fierté d’avoir voté la Loi n° 2012-30
portant création de l’Office national de Lutte contre la Fraude et la Corruption (OFNAC) après avoir largement partagé avec le peuple sénégalais la ferme volonté de se débarrasser définitivement de certaines pratiques de corruption qui ont fini par mettre presque à genoux notre économie.
En 2022, le président Macky Sall a décidé de mettre à la tête de l’ofnac un ancien procureur de la république qui avait systématiquement refusé de donner suite aux rapports dudit organe quand il était aux affaires.
Celui qui ne voulait pas, en aval, donner de suite aux dossiers ne fera évidemment pas le travail en amont.
L’ofnac devient ainsi une coquille vidée de sa substance : la prévention et la lutte contre la fraude, la corruption, les pratiques assimilées et les infractions connexes, en vue de promouvoir l’intégrité et la probité dans la gestion des affaires publiques.
Nous noterons finalement que l’ofnac qui a remplacé la Commission nationale de lutte contre la non-transparence, la corruption et la concussion (CNICC) n’est finalement qu’un cimetière de la lutte contre la corruption.
En 2016, nous dénoncions déjà l’éviction illégale de l’ancienne directrice de l’ofnac à travers un article intitulé « Affaire Nafi Ngom Keita: les preuves flagrantes de la violation de la loi. »
Après avoir été mis en place en grande pompe L’ofnac a toujours été la cible de Macky Sall qui lui force des œillères par tous les moyens.
Le Sénégal qui a ratifié la Convention des Nations unies contre la corruption adoptée le 31 décembre 2003 et entrée en vigueur le 14 décembre 2005 ainsi que la Convention de l’Union africaine sur la prévention et la lutte contre la corruption adoptée à Maputo le 1er juillet 2003 et ratifiée le 15 février 2007, de même qui est signataire du protocole de la Communauté économique des Etats de l’Afrique de l’Ouest (CEDEAO) adopté à Dakar le 21 décembre 2001 doit être rappelé à l’ordre.
Ces instruments font obligation aux Etats parties d’instituer des organes de lutte contre la corruption. L’ofnac n’en est pas un. Il encourage plutôt la corruption à travers l’organisation institutionnelle d’un défaut de suites accordées au traitement des dossiers le concernant.
