Une bonne partie de nos compatriotes semble attendre la saisine du conseil constitutionnel pour voir la suite à donner à la volonté du Président de la république de réduire son mandat à 5 ans. Cette posture attentiste est motivée par les récentes déclarations du Président Macky Sall sur la question.
Maintenant ce n’est plus ” Je ferai un référendum probablement en octobre 2016″ comme annoncé lors d’une rencontre avec la presse internationale (17 mars 2015) mais c’est plutôt “J’attends la décision qui sera prise par le conseil constitutionnel” comme ce fut récemment le cas en réponse aux déclarations rocambolesques de l’Imam de la grande mosquée de Dakar. Cette même réponse est comme d’habitude rabâcher à longueur de débats et d’interview par les affidés du pouvoir. “Le conseil constitutionnel a le dernier mot”, “Le Président va saisir le conseil qui va décider de la suite à donner à sa volonté de réduire son mandat”…
Cependant, juridiquement, le conseil constitutionnel n’a aucun moyen de demander au Président de ne pas respecter sa promesse. Aucun texte de loi n’autorise le conseil à demander au Président de ne pas saisir le peuple souverain afin de se prononcer sur la réduction de son mandat. Ni la constitution ni la loi organique sur le conseil constitutionnel n’autorise un tel pouvoir.
La saisine du conseil constitutionnel n’est effectuée que dans le cadre d’un avis juridique. Cet avis peut porter sur par exemple les voies à emprunter pour réduire le mandat ou encore sur la légistique, pour une meilleure rédaction de la loi référendaire. Cet avis n’a aucune force contraignante et n’est pas une décision de justice qui s’impose au Président. Ce n’est pas non plus un avis dont la teneur doit être forcément connu du public. Cet même avis est recueilli auprès du Président de l’Assemblée Nationale conformément aux dispositions de l’article 51 de la constitution.
En d’autres termes, la décision de consulter le peuple à travers un référendum ne peut être invalidée par le conseil constitutionnel. Il n’en a pas les prérogatives. C’est une voie légale et royale. Elle est au-dessus de toute décision judiciaire ou parlementaire.
Ainsi, pour revenir sur la promesse de réduire son mandat à 5 ans, le Président n’a qu’une seule et unique issue: Le Wax waxéte. Ce qui signifie qu’il aura décidé d’une manière unilatérale et volontaire de revenir sur sa promesse.
Ni le conseil constitutionnel ni un sermon politicien ne peuvent lui servir de bouée de sauvetage.
Il s’agira de respecter sa parole ou de la trahir.
