Le dialogue convoqué par le président Macky Sall à Diamniadio a révélé qu’à la place d’une sortie de crise nous nous enfonçons dans un brouillard qui risque de créer un carambolage entre les dispositions de la loi d’une part et les institutions de la République telles que le Conseil constitutionnel, l’Assemblée nationale et le Président de la République, d’autre part.
Sur le choix de la date du 2 juin 2024
Le décret qui fixera cette date sera contraire aux dispositions de la constitution. Elle ne pourra pas viser la constitution sans que l’article 31 qui fixe la fourchette légale ne soit modifié par dérogation.
Or cet article est couvert du drap de l’intangibilité.
Si l’Assemble nationale touche de nouveau à cet article, le Conseil constitutionnel saisi n’aura d’autres choix que de déclarer le projet ou la proposition de loi non conforme à la constitution.
Et nous nous retrouverons ainsi à la case de départ.
Si une loi ne change pas les dispositions de l’article 31 et ce n’est évidemment pas possible, le décret n’aura pas de base légale.
Conclusion : une élection le 2 juin n’aura aucune base légale. Elle ne peut pas non plus être justifiée par un quelconque consensus d’autant plus que 17 sur les 19 candidats n’ont pas donné leur accord pour le choix de cette date.
Le Président qui en serait issu sera frappé d’une illégalité congénitale.
Sur la réévaluation des dossiers des candidats dits spoliés
Cette mesure n’a aucune chance d’aboutir au regard de la jurisprudence et des dispositions de la Constitution.
Le Conseil constitutionnel dans sa décision n° 2-E-2007 du 27 janvier 2007 affaire n° 2-E-2007, statuant en matière électorale avait rejeté la réclamation de Yoro FALL, candidat indépendant à l’élection présidentielle du 25 février 2007, dirigée contre la décision du Conseil constitutionnel n°1/E/2007 rendue le 26 janvier 2007.
Le Conseil constitutionnel avait évoqué les dispositions de l’article 92 alinéa 2 de la constitution, considérant d’une part, que « cette disposition exclut tout recours contre les décisions du Conseil constitutionnel, notamment en matière électorale tant devant le Conseil lui-même que devant toute autre juridiction et, d’autre part, que selon l’article 12 de la loi organique sur le Conseil constitutionnel, « la procédure devant le Conseil constitutionnel n’est pas contradictoire »
Cette jurisprudence du Conseil constitutionnel qui exclut toute possibilité de revenir sur ses propres décisions a été plus tard opposé aux candidats indépendants Abdourahmane Sarr, Kéba Keinde et Youssou Ndour, statuant en matière électorale sur la réclamation dirigée contre la décision du Conseil constitutionnel
n° 1/E/2012 rendue le 28 janvier 2012.
Le Conseil constitutionnel avait même cité la jurisprudence Yoro Fall dans son considérant 3 en ces termes : « considérant qu’il résulte de ce qui précède, et conformément à la jurisprudence du Conseil (2/E/2007, Yoro FALL), les réclamations doivent être rejetées »
Cette jurisprudence du Conseil constitutionnel a prévalu jusqu’ici et elle s’adosse sur une disposition de la constitution en vigueur et de la loi organique relative au Conseil constitutionnel.
Sur la saisine du Conseil constitutionnel
Le président de la République a plusieurs fois répété sa volonté de saisir le Conseil constitutionnel pour qu’il se prononce sur la période entre la fin de son mandat et l’installation de son successeur plusieurs mois plus tard. Les dispositions de l’article 36 sont ainsi brandies lors des conclaves de Diamniadio pour que le Président de la République puisse bénéficier d’un allongement de son mandat jusqu’à l’installation de son successeur.
Le Conseil constitutionnel a déjà donné une réponse claire en écartant l’article 2 de la proposition de loi constitutionnelle N°04/2024 portant dérogation aux dispositions de l’article 31 de la Constitution qui disposait que « Le Président de la République en exercice poursuit ses fonctions jusqu’à l’installation de son successeur. »
Cet article a été déclaré non conforme à la constitution.
L’article 36 que les tenants du pouvoir voudraient adapter à la circonstance, adopte les mêmes contours que l’article 2 susvisé qui a été déjà écarté dans le cadre de la prolongation indue du mandat du Président de la République.
Cet article qui, dispose que « Le Président de la République en exercice reste en fonction jusqu’à l’installation de son successeur. » ne doit donc en aucune manière être adapté à cette situation par le Conseil Constitutionnel après qu’il eut clairement précisé dans sa décision n 1/c/2024 du 15 février 2024 que « la durée du mandat du Président de la République ne peut être réduite ou allongée au gré des circonstances politiques, quel que soit l’objectif poursuivi ».
En définitive la situation actuelle présente un imbroglio juridique sciemment créé par le Président Macky Sall qui a décidé de stopper le processus électoral sans aucune base légale et de gagner du temps malgré la décision du conseil constitutionnel l’enjoignant de choisir une date, nous plongeant ainsi dans l’inconnu.
Quelle loi violer pour pouvoir avancer ? C’est la sempiternelle question que se posent aujourd’hui et tristement nos dirigeants face à cette situation inédite.
Le Sénégal ne mérite pas un tel traitement de la part de l’unique responsable : le Président Macky Sall.
