Ceux qui se sont battus contre les violations des droits de Khalifa Sall et de Karim Wade ou qui ont eu à utiliser ces violations comme fonds de commerce politique ne doivent pas s’opposer à leur réhabilitation.
Le fait de penser que cela va diviser l’opposition donne l’idée que d’aucuns n’envisageraient l’unification de l’opposition que dans le contexte où ces deux K sont inéligibles.
Le Président Macky Sall est dans des calculs politiques en prenant une telle initiative mais il est le plus indiqué pour rétablir la justice pour ces deux leaders politiques après avoir délibérément attenté à leurs droits. Ce que des juridictions étrangères ont largement relevé. Alors, mieux vaut tard que jamais.
L’amnistie est une loi. Elle vise à enterrer définitivement des faits.
Aujourd’hui, il doit s’agir d’enterrer définitivement ces pratiques injustes visant à exclure un adversaire politique de la course électorale par voie de justice. Oublier définitivement de telles pratiques et s’orienter vers le respect strict des règles démocratiques. C’est pourquoi la légistique dans la rédaction de la loi d’amnistie est importante. Il ne peut être question de chercher à enterrer des crimes économiques commis par d’autres par le truchement du caractère général et impersonnel de la loi. Toute l’attention doit être portée sur la manière dont la loi d’amnistie sera rédigée.
La grâce dont Karim Wade et Khalifa Sall ont bénéficié et qui a été un coup politique de Macky Sall n’a évidemment pas réglé le problème d’éligibilité car une grâce n’efface pas la peine.
La modification du code électoral souvent évoquée, devant permettre de rétablir leur éligibilité ne règle la question qu’en partie.
En effet la modification de la loi électorale ne touche pas à la peine et à son exécution, ainsi que ses conséquences en dehors de l’aspect électoral. que Karim Wade doit verser au trésor public sur décision de la Cour de répression de l’enrichissement illicite (Crei).

D’ailleurs, le 12 novembre 2018, l’ancien Premier ministre Mimi Touré n’avait pas manqué d’avertir Karim Wade sur sa volonté de retour au pays, en ces termes : « avant de fouler le tarmac de l’aéroport international Blaise Diagne, il doit passer au Trésor public et payer les 138 milliards de francs Cfa de dommages intérêts qu’il doit à l’État du Sénégal ».
La modification du code électoral pour satisfaire les préoccupations de deux personnes viole, d’une certaine manière, le principe du caractère impersonnel de la loi. Il s’y ajoute que si tout se passe bien et que le droit est dit une personne coupable de détournement de deniers publics ou d’enrichissement illicite ne doit effectivement pas être éligible.
La loi ne disposant que pour l’avenir, nous risquons évidemment d’encourager les détournements de deniers publics au détriment du peuple sénégalais si l’éligibilité des auteurs de ces délits est consacrée.
