Les arguments avancés par le gouvernement, à travers son porte-parole, pour justifier une éventuelle suppression de la Ville de Dakar sont contraires au contenu du Code général et des collectivités locales (CGCL). La base légale invoquée n’est pas conforme aux dispositions de la loi. Le porte-parole du gouvernement affirme : « La Ville n’a pas sa raison d’être. On ne peut être en même temps département et commune. Aujourd’hui, nous devons nous conformer au code. C’est-à -dire, l’existence de deux entités que sont le département et la commune. »
Effectivement, le Code général des collectivités locales, en son article 1er dispose : « Dans le respect de l’unité nationale et de l’intégrité du territoire, les collectivités locales de la République sont le département et la commune. »
Il est ainsi bien clair que la Ville n’est pas nommément désigée comme une collectivité locale dans l’article 1er. Cependant, elle en a le titre. L’article 167 dernier alinéa du Code général des collectivités locales est sans équivoque : « La Ville a le statut de commune. »
Les choses sont simples : la commune étant une collectivité locale (art 1er CGCL), la ville ayant le statut de commune (art 167 CGCL), est par conséquent une collectivité locale.
Il s’y ajoute que nullement, il a été établi dans le CGCL que la Ville est un département. Elle a plutôt le statut de commune comme précisé ci-haut. C’est juste à titre dérogatoire que les attributions dévolues au Conseil départemental par le CGCL sont exercées, le cas échéant, par la Ville si son périmètre correspond au territoire du département (article 28 CGCL).
