À travers un communiqué de son porte-parole, il est indiqué que le président de la République a promulgué, ce 19 janvier 2021, la loi n°2021-18 modifiant la loi n°69-29 du 29 avril 1969 relative à l’état d’urgence et à l’état de siège.
L’Assemblée nationale n’a finalement charrié que une série inédite d’illégalités et de fuite de responsabilités.
De l’illégalité des actes posés par le parlement
Il est heureux de voir que l’Assemblée nationale du Sénégal, à l’instar de toutes les assemblées au monde, a voulu adapter son fonctionnement au contexte de pandémie. Ainsi, il a été décidé de réduire le nombre de représentants dans les séances plénières et en commission.
Cette mesure allant dans le sens de créer les conditions de respect des mesures sanitaires, est à saluer. Cependant, l’Assemblée nationale a adopté une démarche inédite qui jure avec les principes de la démocratie et d’un État de droit.
En effet, le nombre de députés avait été souvent réduit sans permettre aux “exclus” de voter. La présence physique et le vote ont été associés : ne vote pas celui qui n’est pas présent, physiquement. Ce fut le cas, par exemple, lors du vote de la loi d’habilitation durant lequel seuls 33 députés ont été autorisés à se présenter physiquement et à voter.
C’est ainsi qu’il a été déclaré que cette loi a été votée à l’unanimité. Hors plusieurs députés de l’opposition avaient manifesté leur désaccord. Ils s’étaient contentés d’écrire des textes pour le signifier.
Ces mesures ont été en parfaite violation des dispositions de la Constitution. En effet, l’article 64 de la Constitution sénégalaise dispose en son alinéa 1 : « Le vote des députés est personnel. Tout mandat impératif est nul. »
Dans tous les pays où des mesures ont été prises pour s’adapter à la pandémie, la loi a été respectée quant au rôle de représentativité du député. On ne prive pas un député du vote. Il jouit d’un mandat représentatif incompressible et le mandat impératif est nul.
C’est pourquoi les parlements à travers le monde ont fait preuve d’ingéniosité, pour faire voter tous les députés, tout en respectant les mesures sanitaires. C’est le cas en France, par exemple, où un dispositif a été mis en place pour permettre aux présidents de chaque groupe politique de porter les votes de tous les députés du groupe, permettant à ces derniers d’accomplir leur devoir (voter) sans siéger.
Le Parlement sud-africain a modifié son règlement intérieur pour permettre aux deux chambres, l’Assemblée nationale et le Conseil national des provinces, de fonctionner à distance.
En Autriche où les réunions à distance ne sont pas autorisées par la Constitution fédérale et le règlement intérieur, la répartition des sièges dans l’hémicycle a été adaptée pour garantir les distances recommandées entre les parlementaires.
A chaque parlement ou Assemblée nationale sa mesure d’adaptation face à la Covid-19, dans le strict respect de la loi.
Au Sénégal, la loi a été tout simplement violée. Ce qui rend nul et non avenu le processus ayant conduit aux lois votées dans le cadre du mandat impératif qui pourrait s’intituler « restez chez vous sans avoir la possibilité de voter ».
Il s’y ajoute que les huis clos décrétés ne répondent aucunement aux dispositions de la loi. C’est le président de l’Assemblée nationale qui déclare qu’il a été convenu d’un huis clos alors que la loi est claire et dispose autrement : l’article 62 du règlement intérieur de l’Assemblée nationale précise que la proposition de huis clos doit être soumise à l’Assemblée nationale qui doit se prononcer à la majorité des membres.
Les huis clos décrétés sont, en plus, accompagnés de choix délibérés et unilatéraux de présence de la presse. Les médias d’Etat sont acceptés et ceux privés écartés.
De la fuite de responsabilité de l’Assemblée nationale
À côté des violations de la loi, l’Assemblée nationale a très souvent déserté ses responsabilités. Les députés ont pour, entre autres, missions de contrôler l’action du gouvernement. Lors de la gestion de la pandémie beaucoup de questions liées à la distribution des vivres, à l’utilisation des ressources financières allouées à la pandémie et à la gestion sanitaire ont suscité débats et incompréhensions.
L’Assemblée nationale, pour pouvoir contrôler l’action gouvernementale, dispose de plusieurs leviers. L’article 85 de la Constitution permet, par exemple, aux députés de poser aux membres du gouvernement qui sont tenus d’y répondre, des questions écrites et des questions orales avec ou sans débat. Ils peuvent également constituer des commissions d’enquête parlementaire.
Aucune de ces prérogatives sus-énumérées n’a été utilisée pour jouer pleinement le rôle que confère le peuple sénégalais à l’Assemblée nationale à travers les lois votées. Les initiatives des députés de l’opposition ont été tout bonnement ignorées.
Le gouvernement a plutôt préféré tenir des conférences et points de presse sans aucune forme de contradiction en livrant aux populations, une communication qui frise la propagande.
Avec le vote de la loi modifiant celle relative à l’état d’urgence et à l’état de siège, l’Assemblée nationale s’écarte définitivement du processus décisionnel en ce qui concerne le régime d’exception que constitue la gestion des catastrophes sanitaires. Le président de la République a ainsi carte blanche pour apprécier seul, la gestion d’une catastrophe sanitaire sur une période d’un mois renouvelable une fois. Il peut décréter autant qu’il veut, sans que l’Assemblée nationale ne puisse intervenir. Une fuite de responsabilités du législatif qui jure avec sa mission de contrôle de l’exécutif.
L’Assemblée nationale n’avait évidemment pas le droit de renoncer à une prérogative constitutionnelle de contrôle de l’exécutif en s’écartant délibérément du processus décisionnel quant à la gestion d’un régime d’exception. Cette fuite de responsabilités est préjudiciable à la démocratie et au mandat représentatif.
L’Assemblée nationale n’a été présente durant cette pandémie que pour répondre aux désirs de l’exécutif. Les préoccupations du peuples ont été totalement ignorées sur le lit de l’illégalité et de la fuite de responsabilités.
