Des voix s’élèvent au sein du parti au pouvoir pour inciter le Président de la république Macky Sall à revenir sur son engagement de faire un mandat de 5 ans. Contrairement à l’attitude de remise à l’ordre qu’il a toujours eue face aux dérives de certains membres de son parti, le Président Macky Sall a, cette fois-ci, trop laisser-faire. Cette nouvelle approche qui a mis à contribution ses proches collaborateurs renseigne sur une stratégie que le temps ne tardera certainement pas de révéler.
Cependant, tout porte à croire que le Président Macky Sall est derrière le débat sur la faisabilité du respect de son engagement que ses propres partisans ont diversement animés. En atteste sa dernière sortie à Nioro ce dimanche 12 avril en ces termes « Il y a un débat de fond pour déterminer les procédures de faisabilité. Ce débat de fond est pris en charge par les spécialistes. Ce n’est pas à moi de choisir la procédure ». En faisant une telle déclaration, le Président Macky Sall conforte les positions de ses propres partisans et revient sur son autre engagement de faire un référendum en Mai 2016.
Cependant, eu égard aux argumentaires développés ça et là par les partisans du Wax waxeet et dont le but est de semer le doute dans la tête des sénégalais, il sied d’apporter les précisions suivantes.
Ils disent que le Président de la république a juré de respecter et de faire respecter la constitution. Par conséquent il ne peut la toucher pour réduire son mandat de 7 à 5 ans
Dites-leur que le président Macky Sall a touché au moins à 2 reprises à la constitution depuis son accession au pouvoir. Ce fut le cas d’abord quand il a décidé de supprimer le SÉNAT ensuite quand il a choisi de remplacer le Conseil Economique et Social (CES) par le Conseil Economique Social et Environnemental ( CESE).
Dites-leur que cela a été possible parce que la constitution prévoit sa propre révision en son article 103.
Par conséquent, une révision constitutionnelle visant la réduction de la durée du mandat du président de la république est bien prévue par la même constitution qui a permis au Président Macky Sall de supprimer le SÉNAT et de créer le Conseil Économique Social et Environnemental.
Ils disent que le référendum est coûteux
Dites-leur que c’est le Président de la république qui a décidé d’aller au référendum qui est certes, une voie légale et royale mais qu’il pouvait passer par la voie parlementaire comme ce fut le cas avec la suppression du SÉNAT et la création du CESE. Cela n’aurait presque rien coûté à l’Etat.
Ils disent que la limitation de la durée du mandat ne peut passer que par voie référendaire
Dites-leur que l’interprétation de l’article 27 de la constitution qui aboutit à l’exigence de passer par la voie référendaire était valable dans sa formulation de 2001. La disposition de 2001 a été modifiée en 2008 par la Loi constitutionnelle n° 2008-66 du 21 octobre 2008. Le constituant a changé (c’est le législateur), l’esprit a changé (c’est la possibilité d’une révision par voie parlementaire). La nouvelle interprétation ne peut alors se faire que sur la base de la loi qui s’applique erga omnes c’est à dire la loi de 2008. Or le législateur a choisi d’adopter cette loi par la voix parlementaire et c’est cette procédure qui a permis d’aboutir à la durée de 7 ans que les partisans du Wax waxeet cherchent à nous imposer.
Il est donc absurde de dire que les 7 ans sont légaux mais que la procédure qui a permis d’arriver à cette durée est illégale.
Ils disent que le Président ne peut démissionner qu’en cas d’incapacité
Dites-leur que cette affirmation n’existe pas dans la constitution sénégalaise. La constitution prévoit la vacance du pouvoir et l’organisation du scrutin dans les soixante jours au moins et quatre vingt dix jours au plus, après la constatation de la vacance par le Conseil constitutionnel «en cas de démission, d’empêchement définitif ou de décès » (art 39 de la constitution)
La démission est constatée par le conseil constitutionnel qui doit être saisi par le Président de la république ( art 40 de la constitution)
Le Président peut donc décider de démissionner quand il veut sans souffrir d’aucune incapacité.
Ils disent que la loi ne peut pas rétroagir
Dites-leur que Le principe de la non-rétroactivité des lois comporte des limites parmi lesquelles et en l’espèce, les lois expressément rétroactives. Par lois expressément rétroactives, il faut entendre une loi dont les effets remontent dans le passé et qui a pour conséquence de faire renaître des droits qui n’existaient pas à l’origine. C’est une loi dont le législateur a décidé expressément qu’elle serait rétroactive. Elle trouve ou justifie sa nature dans la volonté du législateur.
Dites-leur donc qu’on pourra juste ajouter des termes du genre « cette disposition s’applique au mandat en cours ». Cette question pourra être réglée dans les dispositions transitoires.
D’ailleurs une loi expressément rétroactive a été votée sous le magistère du Président Macky Sall. C’est la loi sur la baisse des loyers qui s’est appliquée sur les loyers en cours qui ont déjà fait l’objet de contrats.
En définitive, le Président de la république dispose d’au moins trois possibilités pour respecter son engagement. Il peut passer par la voie parlementaire, par la voie référendaire ou tout simplement démissionner. La balle est dans son camp.
