Nulle part dans la loi 2012/30 du 28 décembre 2012 portant création de l’Office National de Lutte contre la Fraude et la corruption, il n’est prévu le remplacement du Président de l’OFNAC sans la survenance des conditions suivantes : démission, décès, faute lourde ou empêchement de l’intéressé dûment constatés par la majorité des membres sur le rapport du vice-President (article 6).
Il se trouve, cependant, qu’aucune des conditions fixées à l’article 6 n’est intervenue, en l’espèce.
La fin du mandat évoquée ne peut nullement entraîner le remplacement solitaire du Président de l’OFNAC. La loi 2012/30 est très claire sur ce point. L’article 5 évoque le renouvellement (une fois) qui se « fait par moitié tous les trois ans ». Autrement dit, c’est une moitié qui est renouvelée et l’autre moitié reste. Le remplacement solitaire d’un membre ne répond à aucune disposition légale. Le remplacement du Président telle qu’il a été effectué est donc une violation flagrante de la loi.
En ce qui concerne le mandat des 12 membres de l’ofnac, il prend effet à compter de la date de leur prestation de serment. L’article 10 de la loi 2012/30 dispose: « Avant leur entrée en fonction, ils prêtent, devant la cour d’appel de Dakar, siégeant en audience solennelle, le serment dont la teneur suit « (…) »
Autrement dit, aucun membre de l’ofnac ne peut exercer sa mission sans au préalable entrer en fonction et pour ce faire, il faut nécessairement qu’il prête serment devant la cour d’appel.
Par conséquent, le début du mandat des membres de l’ofnac est le lendemain de leur prestation de serment c’est à dire, le 26 Mars 2014 et devait prendre fin le 26 Mars 2017.
Aucune autre considération élevée au rang de « pratique administrative » par les tenants du pouvoir ne peut déroger à la loi du point de vue de la hiérarchisation des normes juridiques.
La perception d’un salaire ne peut justifier la prise de fonction. C’est la prestation de serment qui inaugure le mandat conformément aux dispositions précitées.
Le régime du Président Macky Sall a, dans cette affaire et encore une fois, honteusement violé la loi.
