Si le Président de la république a la possibilité de contourner la loi et qu’il soit autorisé à le faire par le conseil constitutionnel, de quelle manière il matérialisera sa décision ?

3. Par une simple publication de l’avis du conseil constitutionnel ?
Depuis quand un avis peut suppléer la loi ? Surtout lorsque celle-ci est explicite et n’est susceptible d’aucune interprétation ?
Le fait que le conseil constitutionnel motive sa décision par l’expression « A titre exceptionnel » révèle une volonté réelle de s’arroger des prérogatives factuelles sans aucun soubassement juridique.
Nulle part dans la Loi organique n° 2016-23 du 14 juillet 2016 relative au Conseil constitutionnel (art 1er et art 2) qui abroge et remplace la loi n° 92-23 du 30 mai 1992 sur le Conseil constitutionnel, il n’est prévu la compétence du conseil constitutionnel à statuer sur une situation « A titre exceptionnel », qui est de fait une dérogation à la loi.
Nulle part dans la constitution sénégalaise, il n’est prévu de permettre au Président de la république de se substituer à la loi « A titre exceptionnel », en matière électorale.
La décision du conseil constitutionnel autorisant le vote des électeurs sénégalais par un récépissé d’inscription accompagné d’une carte d’identité numérisée, d’une carte d’électeur numérisée, d’un passeport ou, pour les primo-inscrits ne disposant pas des trois pièces administratives précédentes, d’un document d’immatriculation, est de la philosophie politique qui risque de se traduire en une honteuse jurisprudence qui fait fi des règles élémentaires du droit.Au finale, l’avis du conseil constitutionnel constitue manifestement une violation de la loi.
